Little Riders Club Release and Waiver Form
In this agreement, you, your and yourself includes you personally, the participant(s) (which may be any person in your care, including minors under 18 years of age) and anyone, participant or otherwise, within your group whom may have accompanied you and who is in the care and control of you or the participant(s).
By signing this form you are waiving your rights to sue Balloonaversal Entertainments, its successors and assigns (Balloonaversal Entertainments) and allow Balloonaversal Entertainments to offer medical attention in the event of an accident. The purpose of this agreement is to indemnify Balloonaversal Entertainments and each of its personnel (including its instructor/guide or any of its employees or agents) against any and all claims, losses, costs, damages, expenses and liabilities (including legal costs on a full indemnity basis) sustained or incurred by Balloonaversal Entertainments or any of its personnel in connection with: any claim, action, demand or proceedings (whether based in contract, tort (including negligence) or otherwise) by any person in relation to any personal injury occasioned by you at, or as a result of, Balloonaversal Entertainments, or in the course of, or as a result of, any activities (including horse trail riding, riding lessons and associated activities) supplied by Balloonaversal Entertainments. This includes personal injury or death to you, howsoever caused, who signed this form as acknowledgment of the terms and conditions of this exclusion to sue.
You agree to immediately report any injury to yourself or the horse to the person in charge of the activity. In addition, you are authorising Balloonaversal Entertainments and its personnel to administer first aid and call an ambulance if deemed necessary for the medical attention of you. You personally agree to bear any and all cost thereby incurred. You acknowledge that at all times of participation in the activity is done at Your own risk.
CONDUCT
You understand and acknowledge that horse riding is a dangerous activity and that horses can act in a sudden and unpredictable way, especially if frightened or hurt, which notwithstanding the best endeavours, skill, care and diligence of the rider, handler, guide or instructor creates an unavoidable risk of physical harm. You also acknowledge that the purpose of the activity is for the benefit of you and your child and that at all times you are responsible for your own actions and the actions of those other people in your care and control. You understand and acknowledge that serious INJURY or DEATH may result from horse riding activities and you consequently agree that you participate at your own risk and that Balloonaversal Entertainments, Michelle and Peter Patterson and/or their personnel shall not be liable for your personal injury, death, loss or damage occasioned to any of your possessions whether such liability arises out of any express or implied term of the activity, or at common law or in any other way.
MEDIA CONSENT
I hereby consent to the participation in interviews, the use of quotes, and the taking of photographs, movies or video of child named above by.
I also grant to the right to edit, use, and reuse said products for use in social media and advertising, marketing including use in print, on the internet, and all other forms of media. I also hereby release Balloonaversal Entertainments and its agents and employees from all claims, demands, and liabilities whatsoever in connection with the above.
WAIVER AND AGREEMENT
You understand that placing your name, address and phone number on this document constitutes a complete and unconditional release of all liability of Balloonaversal Entertainments, its successors and assigns, Peter and Michelle Patterson and/or the Personnel to the greatest extent allowed by law in the event that you suffer any property damage, injury or death.
You have had sufficient opportunity to read this release and waiver of liability and assumption of risk agreement, fully understand its terms and sign it freely and voluntarily without inducement of any kind.
